Welcome to Splitcopy ("Splitcopy," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Splitcopy website (splitcopy.com) and our dynamic text optimization services (the "Service").

By registering for an account or integrating our script into your website, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Splitcopy provides a JavaScript-based optimization tool that uses Multi-Armed Bandit (MAB) algorithms to dynamically swap text variants on your website to maximize conversions.

We grant you a limited, non-exclusive, revocable license to use the Service and embed our JavaScript snippet on your authorized domains.

We reserve the right to modify, update, or discontinue features of the Service at any time.

2. User Accounts & Responsibilities

  • Eligibility: You must be at least 18 years old to use the Service.
  • Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
  • Lawful Use: You agree to use the Service only on websites you own or have explicit authorization to modify. You may not use the Service to display illegal, harmful, or deceptive content.

3. Data Privacy & GDPR Compliance

Because Splitcopy tracks views and clicks (Event Data) on your website to train our ML algorithms:

  • Your Role (Data Controller): You are solely responsible for ensuring your website complies with all applicable privacy laws (e.g., GDPR, CCPA). You must maintain a legally compliant Privacy Policy that informs your End-Users about third-party optimization tools and data collection.
  • Our Role (Data Processor): We act as your Data Processor. We process Event Data and sessionStorage strictly to provide the Service, as detailed in our Privacy Policy.
  • Data Processing Agreement (DPA): If you are subject to the GDPR, our Data Processing Agreement is incorporated into these Terms by reference. Please contact us to execute a DPA.

4. Billing, Payments & Subscriptions

  • Payments: All subscriptions are billed securely via our third-party payment processor, Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis (e.g., monthly).
  • Cancellations: You may cancel your subscription at any time via your Splitcopy dashboard. Cancellation will take effect at the end of your current billing cycle.
  • Refunds: All payments are non-refundable unless otherwise required by law. We do not provide prorated refunds for partial usage.

5. Intellectual Property

  • Your Content: You retain all ownership rights to the original text, content, and design of your website.
  • Our Property: Splitcopy retains all rights, title, and interest in the Service, including the JS script, algorithms, dashboard UI, and underlying software.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available."

We make no warranties, express or implied, regarding the Service's uptime, accuracy, or ability to increase your website's conversion rates. We specifically disclaim all implied warranties of merchantability and fitness for a particular purpose.

7. Limitation of Liability

To the maximum extent permitted by law, Splitcopy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business goodwill, arising out of or in connection with your use of the Service.

In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim.

8. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, including for violations of these Terms. Upon termination, you must immediately remove the Splitcopy script from your websites.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law principles. Any disputes shall be resolved in the competent courts located in Porto.

10. Changes to these Terms

We may update these Terms from time to time. We will notify you of any material changes via email or an alert in the Splitcopy dashboard. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
